The interference of the social function of the riverside property in Petrolina-PE and its impact on intergenerational equity

Turning to the study of the urbanization process, the urban history, it is seen that throughout the trajectory of mankind the cities almost always emerged near rivers, lakes and seas. The objective of this work is to analyze the impact of the (in)management of the Social Function of the Property Right in the use and occupation of the land on the banks of the São Francisco River with a view to the applicability of the Intergenerational Equity Principle. As methodology of this work, a bibliographical survey was carried out on the classification of the environmental characteristics of the study area through consultation of the Constitution, Forestry Code, Municipal Master Plan of Petrolina-PE and the main environmental laws governing the national policies of Permanent Preservation Areas - PPA's. The study area comprises the São Francisco river in the municipality of Petrolina-PE, which covers both urban and rural areas and has 18.4 km of riverbank, most of it in the urban area. The results indicate that irrigated agriculture and rapid population growth in the last 40 years brought about socio-economic transformation and consecrated the municipality of Petrolina as a reference of modern services, and made imperative the challenge of reconciling urban development and environmental preservation. The APP's are areas designated solely for the protection of their ecological functions, therefore, there should be no constructions, plantations or exploitation of economic activity in these areas characterized by law or act of the Public Authority as permanent preservation
