NASCENTES NA LEGISLAÇÃO BRASILEIRA: IMPLICAÇÕES E CONSEQUÊNCIAS PARA O GERECIAMENTO HÍDRICO AMBIENTAL

Abstract

Water is a vital element for living beings as well as for the development of society. Ensuring the quality and conservation of water resources is the responsibility of the government and depends, above all, on the capacity to implement environmental policies. The Brazilian legislation presents instruments with different approaches to water, and currently this element is safeguarded under the understanding of Art. 225 of the Federal Constitution. However, conflicts have been observed between regulatory frameworks and have consequently reverberated into negative impacts on natural systems. Thus, within the environmental water management, the systems of drainage springs, a strategic environment for water production, stood out. Amid the discussion on the private domain of the waters and the guidelines found in the environmental legislation, one sees with concern the treatment and management of the spring environments. To support this discussion, a case study was presented on the sources of the Pacoti River, an important watercourse for the supply of the city of Fortaleza. It is considered that a greater contribution of knowledge about the environmental dynamics of the springs is necessary for the development of more efficient policies regarding the conservation and management of these water sources.
